I bought an ic902 and was told by a Business Rep and a Store Rep that my ic902 would work anwhere my sprint phone worked. Within a couple weeks, I noticed it didn’t work in Colorado and called tech support from an Alltel phone. They said that I needed to upgrade the firmware when I was back in a Sprint area. About a month later, I went back to eastern Colorado. Since I upgraded my firmware, I took their word that this would fix the problem but my phone still didn’t work. By this time, I was beyond the 30 day return time. I called them from an Alltel again and was told that it must be something with my phone and they asked me to take it to a repair center. They didn’t find any problems. This went on for about 4 months before I found out that my ic902 wouldn’t roam on alltel’s network the way my old Sprint phone would.
I talked to the rep at the store who basically said he was sorry that they misinformed me but I was stuck. I tried explaining my situation to a CSR and finally was transferred to Retentions. They will not allow me to get out of my contract. Their only option was to give me a $200 discount on any new sprint phone as long as I agreed to a new 2 year contract.
If I don’t get to keep direct connect, I do not want to stay with Sprint. It is the only reason I bought the hybrid in the first place.
This week, I had other problems with my hybrid. I took it to a Sprint repair center and was told they could fix it but they would charge me $35. If I wanted to fix it under warranty, I would have to send it to motorola. I asked them if I could swap handsets to a legacy Nextel phone (i355) and they said I could. They said I would have to change my rate plan because this is an iden phone but the rates would remain the same. I specifically asked him about text messages and he said the rate wouldn’t change. I came home and got the other phone, then called premier care to make the swap. I again asked if my charges would be different and he said they wouldn’t. He also said he would put a note into my account that he told me the rates and services would stay the same when I received my ic902 from repair.
Tonight, I looked at my account online and found out I was being charged $10.00 for unlimited text messages. On my other phone, there were no charges for text messaging and I have a screen print showing "unlimited text messages".
Since they have changed my plan by adding this charge, can I get out of my contract without an ETF?
